3.) Social media plug-ins

We use plug-ins for the social media networks Facebook, Twitter, and Instagram on our website on the basis of Article 6 (1) sentence 1 (f) GDPR in order to raise the profile of our firm. The advertising objective behind this is considered a legitimate interest for the purposes of the GDPR. Responsibility for compliance with the data protection rules lies with the respective social media provider. We integrate these plug-ins by means of the “two-click” method, in order to protect visitors to our website as effectively as possible.

a) Facebook

Social media plug-ins from Facebook are used on our website to make its use more personal. For this, we use the “Like” and “Share” buttons. This is an offering from Facebook.

When you access a page on our website containing a plug-in of this type, your browser will establish a direct connection with the Facebook servers. Facebook will then transmit the content of the plug-in directly to your browser and integrate it into the website.

By integrating the plug-ins, Facebook receives the information that your browser has accessed the relevant page of our website, even if you do not have a Facebook account or are not currently logged in to Facebook. This information (including your IP address) is transmitted by your browser directly to a Facebook server in the USA and stored there.

If you are logged in to Facebook, Facebook can associate your visit to our website directly with your Facebook account. If you interact with the plug-ins, for example by clicking the “Like” or “Share” buttons, the corresponding information is also transmitted directly to a Facebook server and stored there. The information is also published on Facebook and displayed to your Facebook friends.

Facebook may use this information for the purposes of advertising, market research, and for design the Facebook pages as required. For this purpose, Facebook creates usage, interest and relationship profiles, e.g. to evaluate your use of our website with regard to the advertisements displayed on Facebook, to inform other Facebook users about your activities on our website, and to provide other services related to the use of Facebook.

If you do not want Facebook to associate the data collected via our website with your Facebook account, you must log out of Facebook before visiting our website.
For the purpose and scope of data collection, the further processing and use of the data by Facebook, and your rights and setting options to protect your privacy, please refer to Facebook’s Data Policy (https://www.facebook.com/about/privacy/).

b) Twitter

Plug-ins of Twitter Inc.’s short message network (Twitter) are integrated on our website. The Twitter plug-ins (tweet buttons) can be recognized by the Twitter logo on our site. An overview of tweet buttons can be found here (https://about.twitter.com/resources/buttons).

When you access a page on our website containing a plug-in of this type, a direct connection will be established between your browser and the Twitter servers. As a result, Twitter receives the information that you have visited our website with your IP address. If you click on the Twitter “tweet button” while logged in to your Twitter account, you can link the contents of our pages to your Twitter profile. This allows Twitter to associate your visit to our pages with your user account. We should like to point out that, as the provider of the pages, we are not aware of the content of the data transmitted or its use by Twitter.

If you do not want Twitter to associate your visit to our website with your Twitter user account, please log out of Twitter.

Further information on this is provided in Twitter’s privacy policy (https://twitter.com/privacy).

c) Instagram

Our website also uses social plug-ins from Instagram, which is operated by Instagram LLC., 1601 Willow Road, Menlo Park, CA 94025, USA (“Instagram”).
The plug-ins are identified with an Instagram logo, for example in the form of an “Instagram camera”.

When you access a page on our website containing a plug-in of this type, your browser will establish a direct connection with the Instagram servers. Instagram will then transmit the content of the plug-in directly to your browser and integrate it into the website. By integrating the plug-ins, Instagram receives the information that your browser has accessed the relevant page of our website, even if you do not have an Instagram account or are not currently logged in to Instagram.

This information (including your IP address) is transmitted by your browser directly to an Instagram server in the USA and stored there. If you are logged in to Instagram, Instagram can associate your visit to our website directly with your Instagram account. If you interact with the plug-ins, for example by clicking the Instagram button, this information is also transmitted directly to an Instagram server and stored there.

The information is also published on your Instagram account and displayed to your contacts.

If you do not want Instagram to associate the data collected via our website directly with your Instagram account, you must log out of Instagram before visiting our website.

Further information on this is available in Instagram’s Data Policy (https://help.instagram.com/155833707900388).

III. Disclosure of data

Your personal data is not disclosed to third parties for purposes other than those listed below.

We only disclose your personal data to third parties if:

  • You have given your express consent pursuant to Article 6 (1) sentence 1 (a) GDPR,
  • The disclosure pursuant to Article 6 (1) sentence 1 (f) GDPR is necessary to assert, exercise or defend legal claims and there is no reason to assume that you have an overriding, legitimate interest in not disclosing your data,
  • a legal obligation exists for the transfer pursuant to Article 6 (1) sentence 1 (c) GDPR, or
  • this is legally permissible and is necessary for the processing of contractual relationships with you in accordance with Article 6 (1) sentence 1 (b) GDPR.

IV. Cookies

We use cookies on our website. Cookies are small files that are automatically created by your browser and stored on your terminal device (laptop, tablet, smartphone, etc.) when you visit our website. Cookies do not cause any damage to your terminal device, and do not contain viruses, trojans or other malware.

The cookie stores information that is produced in connection with the specific terminal device used. However, this does not mean that we can gain direct knowledge of your identity through this.

One reason why we use cookies is to make the use of our website more pleasant for you. For example, we use ‘session cookies’ to tell whether you have already visited individual pages of our website. These are deleted automatically after you leave our site.

We also use temporary cookies to optimize user-friendliness; these are stored on your terminal device for a certain fixed period of time. If you re-visit our site to make use of our services, we will automatically recognize you as a previous visitor, and will remember the entries and settings that you made so that you do not have to enter them again.

Another reason why we use cookies is to statistically record the use of our website and to analyze this so that we can optimize the services that we offer you (see section 5). These cookies enable us to automatically recognize that you have already visited us when you visit our site again. These cookies are automatically deleted after a defined period.

The data processed by cookies is required for the above-mentioned purposes in order to safeguard our legitimate interests and those of third parties in accordance with Article 6 (1) sentence 1 (f) GDPR.

Most browsers automatically accept cookies. While you can configure your browser to ensure that no cookies are stored on your computer or a message always appears before a new cookie is created, the complete deactivation of cookies may mean that you cannot use all of our website’s functions.

V. Web storage

We use web storage (also known as DOM storage or super cookies) on our site. This is a technology for web applications used for storing data in a web browser. DOM storage supports persistent data storage, similar to cookies, as well as local, session-dependent storage.

DOM storage is standardized by the World Wide Web Consortium (W3C). It was originally part of the HTML5 specification, but has since been spun off into a separate specification.

DOM storage can be regarded in a simplified way as a further development of cookies (“super cookies”). The technology offers much greater storage capacity (5 MB per domain in Firefox2, 10 MB per storage area in Internet Explorer3) and better development interfaces.

VI. Analytical tools

a) Tracking tools

The tracking measures listed below and used by us are carried out on the basis of Article 6 (1) sentence 1 (f) GDPR. They are aimed at ensuring that our website is designed to meet the needs of our customers and is continuously optimized. We also using the tracking measures to statistically record the use of our website and to analyze this so that we can optimize the services that we offer you. These interests can be considered legitimate within the meaning of the above provision.

Information on the respective data processing purposes and data categories can be found in the relevant tracking tool details.

i) Google Analytics

We use Google Analytics, a web analysis service of Google Inc.(https://about.google/), 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States (hereinafter “Google”) for the purpose of designing and continuously optimizing our pages to meet your needs. In this context, pseudonymized usage profiles are created and cookies (see section 4) are used. The information generated by the cookie about your use of this website, such as

  • Browser type/version
  • Operating system used
  • Referrer URL (the web page that directed you to our website)
  • Host name of the accessing computer (IP address)
  • Time of the server request

is transferred to a Google server in the USA and stored there. The information is used to analyze the use of the website, compile reports on the website activities and provide further services associated with the use of the website and the internet, for the purposes of market research and to design our pages to meet your needs. This information may also be transferred to third parties if this is required by law or if Google has commissioned third parties to process this data. Under no circumstances will your IP address be associated with any other data held by Google. The IP addresses are anonymized, meaning that an assignment is not possible (IP masking).

You can prevent cookies from being installed by selecting the appropriate settings on your browser. However, please note that if you do this, you may not be able to use the full functionality of this website.

You can also prevent data generated by the cookie and related to your use of this website (including your IP address) from being collected and subsequently processed by Google by downloading and installing a browser add-on (http://tools.google.com/dlpage/gaoptout?hl=en).
As an alternative to the browser add-on, especially for browsers on mobile devices, you can also prevent Google Analytics from collecting data by clicking on this link. An opt-out cookie will be installed to prevent future collection of your information when you visit this site. The opt-out cookie is valid only in this browser and only for our website and is stored on your device. If you delete the cookies in this browser, you must re-install the opt-out cookie.
Further information on data protection in connection with Google Analytics is available in Google Analytics Help (https://support.google.com/analytics/answer/6004245?hl=en).

ii) Google AdWords Conversion Tracking

We also use Google Conversion Tracking to record the use of our website statistically and perform analyses so that we can optimize our website for you. Google AdWords will place a cookie (see section 4) on your computer if you have reached our website via a Google ad.

These cookies lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of the AdWords customer’s website and the cookie has not expired, Google and the customer will be able to tell that the user clicked on the ad and was directed to that page.

Each AdWords customer receives a different cookie, so cookies cannot be tracked via the websites of AdWords customers. The information collected with the aid of the conversion cookie is used to generate conversion statistics for AdWords customers who have opted for conversion tracking. AdWords customers are told the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they are not given any information that can be used to identify users personally.

If you do not wish to participate in the tracking procedure, you can also opt out of installing the necessary cookie – for example, via browser settings that generally deactivate the automatic installation of cookies. You can also disable cookies for conversion tracking by setting your browser to block cookies from the domain “www.googleadservices.com”. Google’s privacy policy on conversion tracking can be found here (https://services.google.com/sitestats/en.html).

iii) Hotjar

In addition to Google AdWords Conversion Tracking, as listed under point ii), Hotjar is also used as a tracking tool to optimize our website. Cookies (see section 4) and web storage are also used in this respect.

The collected cookies are transferred via a TSL encrypted web socket to an AWS server in Ireland for temporary storage for analysis.

Both the cookies and the web storage lose their validity after 30 days and are not used for personal identification. The data is used to determine which areas of the website have a high user volume and where customers come to a halt. However, they are not given any information that can be used to identify users personally.

If you do not wish to participate in the tracking procedure, you can also opt out of installing the necessary cookie – for example, via browser settings that generally deactivate the automatic installation of cookies.

iv) Inspectlet

Inspectlet is used as an additional supplement for website optimization. This component is used as an extension to the previous analytical tools listed under i) to iii) and also tracks via Google tags and cookies.

The data collected is managed by reference to the data protection guidelines of the GDPR. Furthermore, the data is kept for one month on a server in Virginia, USA and then deleted

The following data is collected via cookies:

  • Current URL
  • Country
  • Time zone
  • Browser type and version
  • Terminal device type and version
  • Operating system type and version
  • Referrer URL
  • Mouse activity including pixel coordinates for mouse movements and clicks and keyboard activity typed into non-sensitive input fields
  • HTML content not marked as sensitive content

All data is encrypted during transmission and collected data is stored encrypted at rest using AES encryption. If the customer has enabled IP address anonymization, the last two octets of the IP address will be removed and will not be available to the user or o Inspectlet. Backups of the data collected are made routinely and tested occasionally to verify restore procedure functionality. All data is physically stored only in AWS data centers meeting ISO 27001 compliance.

If you do not wish to participate in the tracking procedure, you can also opt out of installing the necessary cookie – for example, via browser settings that generally deactivate the automatic installation of cookies.

IX. Data security

Within the framework of website visits, we use the widespread SSL (Secure Sockets Layer) protocol in conjunction with the highest applicable encryption level supported by your browser. As a rule, this will be 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can tell whether an individual page of our website is transmitted in encrypted form by the ‘closed’ depiction of the key or lock symbol in the lower status bar of your browser.

In other respects, we use the appropriate technical and organizational security measures to protect your data from accidental or deliberate tampering, partial or complete loss, destruction, or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.
